Below is a sample of my purchase contract. We ask that everyone reads and agrees to this contract before placing a deposit. You will sign this contract at puppy pick. If you have any questions please contact me. Please note this contract is updated as needed and the below sample may not be current.

Spay/Neuter:
Puppy is being placed as PET ONLY, and purchaser is aware of this. This puppy is NOT to be used for breeding or showing. Puppy will be spayed/neutered no later than 12 months of age (12 months from puppy’s birth) at purchaser’s expense. Once this has been done, proof of spay/neuter will be mailed (or emailed) to Breeder at the address at the bottom of this contract. Purchaser has 1 week after the puppy’s 12 month birth date to mail proof of spay/neuter to Seller. After this date, if proof of spay/neuter has not been received this contract including the health/genetic guarantee will be void. This contract will be void if your puppy has been bred please consult your vet for the best time to spay/neuter your pet. Once pup is spayed/neutered registration paperwork will be mailed to owner. Owner must request paperwork and send current mailing info.
*If your veterinarian prefers to delay spay/neuter even further for the developmental benefit of the puppy please have them email me with their explanation as to why, and when they plan to spay/neuter. Please make sure it includes contact info and they have permission to release info to me.
Registration:
This puppy can be registered with CKC (Continental Kennel Club). All registration fees are the responsibility of the Purchaser.
72 Hour Health Warranty:
- This puppy has been checked by Lytle Veterinary Clinic and has received a clean bill of health.
- The breeder is not responsible for any illness or injury acquired by the puppy after leaving our property.
- The breeder is not responsible for any medical cost once the puppy is in the Purchaser’s care.
Purchaser agrees to take puppy to the vet within 72 hours of pick up for a checkup. Proof of visit (copy of vet receipt) must be supplied to Breeder via email or text within 72 hours. No exceptions! If proof is not provided within 72 hours, the health/genetic guarantee, and this contract will be void. If within 72 hours the Purchaser’s veterinarian discovers a chronic or serious health problem with the puppy, immediate proof of medical exam and diagnosis by the veterinarian is required. The vet will need to provide the breeder with all test results and diagnosis in WRITING. Once the breeder’s vet of choice verifies the defect, the pup will be returned to breeder/seller and exchanged for dog of equal value when produced. Minor problems that can be cured or corrected by medication or surgery are not covered by this guarantee. Expense of returning dog to the breeder is the sole responsibility of the buyer. (NO REFUNDS)
As of the pick-up date, the puppy has received proper core vaccinations and de-worming’s. The puppy has had a hands on vet check as well as a fecal exam. The puppy will not be released unless deemed healthy by the veterinarian. The current shot record is provided and is to be taken to the purchaser’s licensed veterinarian to provide information at the time the pup is being vet-checked. Annual shots and health exams are at the purchaser’s expense which also includes any illnesses that may occur during the life of the puppy/dog. The breeder is not responsible for any medical cost once the puppy is in the Purchaser’s care.
The Breeder is not responsible for Distemper, Parvo, and Corona Virus after 24 hours of sale as these are highly contagious diseases and they can be contacted immediately after leaving the breeder. This warranty does not include: fleas, mites, coccidia, giardia or any other intestinal worms/parasites as they are common in dogs and puppies. All puppies receive a fecal exam before going home. If any parasite issues are found they will be treated before leaving. Parasites are common in puppies and it is the purchasers responsibility to continue deworming. We will not be responsible for illnesses or health problems which are diagnosed after this period except where stated in this contract. The Breeder is not responsible for heart worms. Purchaser is required under this contract to provide heart worm prevention once a month for said puppy/dog’s entire life.
A returned puppy/dog must be returned to the seller in good condition, at the buyer’s expense. All registration and papers must be returned to the Breeder. No refund is given for any puppy/dog returned. If shipping is required to return the puppy/dog to the Breeder, that is the Purchaser’s responsibility.
Genetic Warranty:
To the best of our knowledge our puppies are healthy and free from health issues. If within the first year (12 months from birth) a fatal and/or life-threatening genetic disease is found we will refund one half of the purchase price. The Breeder must be notified of the problem within two days of appearance of the issue, and within two days of the licensed veterinarian’s determination that the problem is caused 100% by genetic factors. A second opinion by a second licensed veterinarian, at the purchaser’s expense may be required. If Purchaser fails to notify Breeder of an issue with the puppy or the vet’s findings within the two days’ time, guarantee is considered void. Any physical problem which is or could be the result of illness, trauma, injury or neglect is not covered under this guarantee. (If the dog dies in this time frame a necropsy must be performed to ascertain cause of death.) If the problem is 100% caused by genetic factors and is life threatening, the Breeder will provide a refund of one half of the purchase price. The Purchaser understands that the Breeder has up to 6 months to refund the amount in full.
No refund will be given if the puppy/dog has been bred, rehomed, or if the Purchaser decides to euthanize the puppy. This guarantee applies to the original puppy only and is non-transferable to a second party if the puppy is re-homed.
The Breeder will not be responsible for any medical expenses incurred. Purchaser is fully aware that owning a puppy/dog means trips to the veterinarian and understands that he/she will be responsible for all payments and transportation costs. Puppy is going home with free 30 day pet insurance, Breeder suggests puppy be kept on health insurance for his entire life. All treatment decisions are the responsibility of the Purchaser.
There are certain disorders that may be caused by the environment; for example: allergies, thyroid dysfunction, demodectic mange and other autoimmune disorders that are not covered by this guarantee. This guarantee does not cover non genetic congenital defects. This guarantee does not include poisoning, accidents, injury, negligence or behavioral problems, as training philosophies and environments vary among individuals.
It is understood that this puppy is being sold as a pet and can not be shown or bred. It is understood that certain physical faults may be present in a pet quality puppy that would prohibit it from competing in the conformation ring. These include, but are not limited to: height, curled tail, underbites, overbites, ear size or ear set, coat, cryptorchidism (undescended testicles), hernias, etc. These are not covered under this contract, and a puppy presenting or maturing with these faults do not warrant a refund, as they are cosmetic and or not life threatening. There is also no guarantee of fertility, and fertility issues are not covered under this contract, as this dog should not be bred!
If any part of this contract is violated, no refund will be given.
Puppy Classes:
The Puppy is leaving Breeder with no signs of temperament issues. The Puppy was raised with the Puppy Culture Program and has received age appropriate socialization and enrichment. Purchaser is responsible for proper training of the puppy. Purchaser should always provide puppy with proper supervision especially around young children. It is also important to teach young child how to safely interact with your new puppy. The breeder strongly recommends puppy continue with the Puppy Culture program. Breeder also recommends puppy be placed in a Early Puppy Socialization Class. Breeder recommends a Positive Reinforcement, Force Free, Non Aversive (no shock, no prong), Modern Trainer only. Please consult with your veterinarian about the benefits of early puppy socialization.
“In general, puppies can start puppy socialization classes as early as 7-8 weeks of age. Puppies should receive a minimum of one set of vaccines at least 7 days prior to the first class and a first deworming. Rehoming, Re Selling and Shelters
If the original buyer cannot keep dog for any reason, buyer must notify the breeder by phone or in writing of their intentions. Breeder will choose to either house the dog until a home is found, or assist buyer in interviewing/screening new owners for dog. Under NO circumstances shall dog be surrendered to an Animal Shelter, sold/given to a pet store, sold/given to a pet dealer for re-sale, or sold to any animal testing/research facility. Expense of returning dog to the breeder is the sole responsibility of the buyer. (NO REFUNDS)
This dog is NEVER to be used in any type of dog fighting!
Slander and Social Media
If any disagreement or dispute should arise, Purchaser & Breeder agree that no mention of the issue will be posted on any type of media including social media. If Purchaser violates this clause, Breeder has the option take legal action for any slanderous statements made.
Breach of Contract
Buyer and Breeder have read, and fully understand, and agree with all the terms and conditions of this contract. Any other agreements or amendments to this contract will be written and initialed by both parties. Failure to comply with any of these clauses entitle seller to repossession of the dog and punitive damages for up to 3,500.00 and all legal fees incurred. Court proceedings shall take place in the county of the seller, and possession of dog must be returned to the seller until dispute is settled. This is solely for the protection of the dog, and shall be enforced, particularly in the case of abuse or neglect of the dog.
